CONFIDENTIALITY & PRIVACY POLICY
This document outlines Āio Art Therapy’s privacy practices and policies, and provides information about confidentiality and laws related to the collection, use and disclosure of your personal health information while engaged in services through our organization.
What is Personal Health Information?
The practice of psychotherapy in Ontario is regulated under the provincial Regulated Health Professions Act (RHPA). All identifiable information collected by a psychotherapist about an individual while engaging in psychotherapy services is considered “personal health information” under the Personal Health Information Protection Act (PHIPA, 2004). This includes your name and contact information, the name and contact information for a minor child, as well as any information collected and/or recorded in the course of providing services to you or your minor child. This may include contact information (e.g., name, address, telephone number, e-mail address), personal characteristics (e.g., age, gender, cultural/ethnic background), and health details (e.g., presenting issues, health history, medical/mental health conditions, treatments being received).
Collection of Personal Health Information:
I collect your personal health information directly from you or the parents/caregivers for a minor child, except: (a) when you have provided consent to obtain such information from others (i.e. reports, assessments or other relevant services); and (b) when the law requires or allows me to collect information without your consent (i.e. urgent situations, when information is needed to prevent potential harm).
I collect only information from you that I believe is needed: (a) to provide you with the psychotherapy services you have requested; (b) to maintain contact with you for service-related purposes; and (c) to prevent harm (i.e. an emergency contact).
By law and in accordance with professional standards, I am required to keep a record of services and contacts with you or your minor child. Your record includes information you provided to me or authorized me to receive. This may include results of assessments, consent forms, session notes, billing information, contact logs, and correspondence that I have sent or received related to your service. The physical records are the property of the practice. However, you have rights regarding access to your record and disclosure of information from your record (see below).
At Āio Art Therapy, information is recorded in electronic form, using Jane.app (www.jane.app) a Canadian fully-encrypted service that is private, confidential and meets all of Canada’s privacy laws (PHIPA). Artwork is collected in hardcopy form, and stored in a secure space in the Āio Art Therapy office.
Use of Your Personal Health Information:
Personal health information is collected to provide psychotherapy and/or counselling and/or consultation services to you or your minor child. This includes carrying out all of the functions reasonably necessary to provide those services.
Paper (artwork) and electronic information are secured in a locked or restricted area at all times, and passwords are used on computers. Electronic information is transmitted through the services of Jane.app (www.jane.app), a Canadian fully-encrypted service that is private, confidential and meets all of Canada’s privacy laws (PHIPA). Faxing is sometimes used to send or receive confidential client information.
The College of Registered Psychotherapists of Ontario (CRPO), the organization that regulates psychotherapists in Ontario (in the public interest), may at times access and inspect client records as part of an external audit. All professional persons involved in these activities are required by law to maintain confidentiality of any accessed information.
Disclosure of Your Personal Health Information:
In accordance with the laws, professional standards, and ethical codes I follow, the information you share with Āio Art Therapy remains confidential. This means your information will not be disclosed to anyone without your consent, with the exception of the specific situations outlined below.
Your information may be released without your consent in the following situations:
Missing Persons
If the police present a Court Order, Search Warrant or Urgent Demand for records related to a missing person, I am required to provide the information and/or records sought by police in order to assist with locating that missing person.
Harm to Self / Others
If there is reason to believe that you are in danger of harming yourself or others in ways that may be life-threatening, I am ethically obliged to take action to ensure your safety and/or the safety of others. During initial intake, we will determine a safety plan that feels best and safest for you, and you will have the opportunity to provide prior consent for me to follow the safety plan. Safety plan actions may include contacting your identified emergency contact person, a family member or close other, seeking hospitalization, contacting the police, notifying others at risk, or some combination of these actions.
Abuse / Neglect
If there are reasonable grounds to suspect that a child under 16 years of age is, or may be, in need of protection, I must, by law, report this information to a children’s aid society. Examples of reportable situations include physical harm/abuse, sexual abuse, emotional harm (e.g., verbal abuse, humiliation, witnessing violence), or a pattern of neglect or failure to protect a child from harm. Additionally, if there are reasonable grounds to suspect that a resident of a nursing, retirement or other long-term care home, or an otherwise vulnerable person has suffered harm, or is at risk of harm due to improper or incompetent treatment or care, unlawful conduct, abuse or neglect, or possible misuse or misappropriation of the resident’s money or funding, I am required to report this information to the Registrar of the Retirement Homes Regulatory Authority, long-term care home director or another appropriate regulatory organization.
Sexual Abuse by a Regulated Health Professional
If there are reasonable grounds to believe that another regulated health professional has sexually harassed or abused a client, I must, by law, report this health professional’s name and information related to the sexual abuse to the appropriate regulatory body.
Court Order
Client records can be subpoenaed by a court order and I may be required to testify and give information obtained during the course of any assessment and treatment sessions. This information would never be provided voluntarily without your direct request or permission without the court order. It is important to note that as registered a healthcare professionals, I may also be required to make our files available for audit by my regulatory body (e.g., College of Registered Psychotherapists of Ontario), third-party payer agencies (if applicable, e.g., Financial Services Commission of Ontario) or by the government. These audits are confidential, and a record of the audit will be inserted into your client file.
Please note that the law requires any disclosure of your personal health information to be limited to information that is reasonably necessary for the purpose of the disclosure and not to include private information provided by a third party. Professional ethical standards require that any information that might cause serious harm to someone not be disclosed, unless required by law. When consenting to the disclosure of your personal health information, you may restrict Āio Art Therapy from sharing all or any part of your information or that of your minor child. However, if I believe the information is reasonably necessary for another health service provider to provide appropriate services, I am required by law to inform the other provider that you have refused consent.
Right of Access to Your Personal Health Information:
With a few exceptions, you have the right to access or amend your personal health information. This means that you may request to read clinical notes in your file, ask for corrections to be made to factual information, and for a copy of your health information.
In these cases, I will review the clinical notes with you and help you understand any information that is not clear (e.g., short-forms, technical terms, etc.). Copies of your file will be made available to you within 5 business days.
If there is a reason why I cannot give you access, I will advise you in writing within 30 days if possible, and will outline the reason, as best I can, as to why I cannot give you access.
Retention and Destruction of Personal Health Information:
A record containing your personal health information, information about your therapy sessions, any artwork made in-session, and other materially relevant interactions are maintained in a secured place while you are engaged in Āio Art Therapy services.
I am required to retain your personal health information and artwork for a period of 10 years after my last contact with you (for adults) or 10 years after you turn 18 years of age (for children), whichever is later. Any personal health information that is stored electronically is protected by appropriate security measures (e.g., PHIPA-compliant software that includes bank-level encryption). After 10 years, your personal information is destroyed in a secure manner that protects your privacy.
I destroy paper records containing personal information and artwork through shredding. I remove electronic information through deletion, and we physically destroy the hard drive of discarded hardware. If we are communicating via text on Signal, I delete our texts every 30 days.
Tele-Services (Virtual and Telephone-based Sessions):
Āio Art Therapy offers in-person, virtual (video) and telephone-based options for assessment and treatment services. Virtual and telephone-based sessions are also mental health services, and these have the same purpose or intention as treatment sessions (or psychotherapy) that are conducted face-to-face. We can discuss which mode of service may best suit your needs, and changes can be made throughout the course of your therapy experience with respect to the mode of therapy you feel is best.
Telephone calls and text messaging are offered via free encrypted communications service, Signal. You will need to download Signal onto your phone to participate in this offering. Telephone-based sessions will involve you being contacted by phone at your scheduled appointment time. Please note that in some cases, the Caller ID may show up as “Unknown” or blocked. It’s recommended that you ensure you are available and can answer the call at the scheduled appointment time.
Virtual care is offered through the Janeapp videoconferencing platform. Janeapp videoconferencing meets Canadian privacy laws and is privacy-compliant. Virtual care requires the use of a webcam or smartphone, and a link to the virtual session will be provided by e-mail prior to the session. It is highly recommended that you test your video/audio settings the day before your session, and contact Janeapp’s tech support for assistance if needed. In the event of technical problems during your session, a back-up plan (e.g., a phone number where you can be reached) will be used to restart the session or to reschedule it. If a different videoconferencing platform is ever used for a session; the benefits/risks of that platform will be discussed with you prior to beginning virtual sessions.
Telephone-based sessions will involve you being contacted by phone at your scheduled appointment time. Please note that in some cases, the Caller ID may show up as “Unknown” or blocked. It’s recommended that you ensure you are available and can answer the call at the scheduled appointment time.
Virtual and telephone-based sessions are convenient and may also be used when in-person sessions are not possible. Engaging in treatment using virtual care or by telephone encompasses risks that should also be considered.
If you need to change an appointment from in-person to virtual: Please email, text or call me directly as soon as possible. Appointment types can’t be changed via the Jane booking site; I will do it for you manually.
Please note the following rights and risks in using virtual and telephone-based care:
- The laws and professional standards that apply to regular mental health services apply to virtual and telephone-based care.
- There are exceptions to client confidentiality policies that exist for regular therapy; these also apply to virtual and telephone-based services. The exceptions are provided in the “Disclosure of Personal Health Information” section below.
- You have the right to withdraw your consent at any time. It will not affect your right to further treatment.
- There are circumstances whereby virtual and/or telephone-based sessions may not appropriate for your care. Should this be determined, I will suggest alternative ways to continue your therapy, and we find an alternative that feels good for you.
- Despite best efforts to ensure high standards of technology, there is always a risk that services could be disrupted or distorted by unforeseen technical problems.
Consent to the use of virtual and telephone-based sessions indicates your agreement with the following conditions:
- Confidentiality still applies for mental health tele-services, and the session will not be recorded by me or you without permission from the other person(s).
- It is important to be in a quiet, private space that is free of distractions during the session.
- It is important to use a secure internet connection rather than public/free Wi-Fi.
- For child/adolescent clients, permission of your parent/legal guardian (and their contact information) is required to engage in tele-sessions.
Use of virtual and telephone-based sessions is always voluntary. Please advise me if you no longer wish to engage in tele-services and we will discuss alternate options for you at that time.

It is Āio Art Therapy’s policy to respect your privacy regarding any information I may collect while operating this Website. I respect your privacy and am committed to protecting personally identifiable information you may provide through this Website. Website Visitors
Like most website operators, Āio Art Therapy collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. Āio Art Therapy’s purpose in collecting non-personally identifying information is to better understand how Āio Art Therapy’s visitors use its website.
Āio Art Therapy also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users. Āio Art Therapy only discloses logged in user and commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below.
Gathering of Personally-Identifying Information
Certain visitors to Āio Art Therapy’s website choose to interact with Āio Art Therapy in ways that require Āio Art Therapy to gather personally-identifying information. The amount and type of information that Āio Art Therapy gathers depends on the nature of the interaction. For example, I ask visitors who sign up for the mailing list at https://aioarttherapy.com to provide a username and email address.

The security of your Personal Information is important to me, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. 1. Automatic collection of information
When you open the Website, my servers automatically record information that your browser sends. This data may include information such as your device’s IP address, browser type, and version, operating system type and version, language preferences or the webpage you were visiting before you came to the Website and Services, pages of the Website and Services that you visit, the time spent on those pages, information you search for on the Website, access times and dates, and other statistics.
Information collected automatically is used only to identify potential cases of abuse and establish statistical information regarding the usage and traffic of the Website and Services. This statistical information is not otherwise aggregated in such a way that would identify any particular User of the system.
2. Collection of personal information
You can access and use the Website and Services without telling me who you are or revealing any information by which someone could identify you as a specific, identifiable individual. If, however, you wish to use some of the features offered on the Website, you may be asked to provide certain Personal Information (for example, your name and e-mail address).
I receive and store any information you knowingly provide to me when you fill any forms on the Website. When required, this information may include the following:
– Contact information (such as email address, phone number, etc)
– Basic personal information (such as name, country of residence, etc)
– Sensitive personal information (such as ethnicity, religious beliefs, mental health, etc)

Privacy of children
I do not knowingly collect any Personal Information from children under the age of 13. If you are under the age of 13, please do not submit any Personal Information through the Website and Services. If you have reason to believe that a child under the age of 13 has provided Personal Information to us through the Website and Services, please contact me to request that we delete that child’s Personal Information from my Services.
I encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce this Policy by instructing their children never to provide Personal Information through the Website and Services without their permission. I also ask that all parents and legal guardians overseeing the care of children take the necessary precautions to ensure that their children are instructed to never give out Personal Information when online without their permission.
Use and processing of collected information
I act as a data controller and a data processor when handling Personal Information, unless I have entered into a data processing agreement with you in which case you would be the data controller and I would be the data processor.
My role may also differ depending on the specific situation involving Personal Information. I act in the capacity of a data controller when I ask you to submit your Personal Information that is necessary to ensure your access and use of the Website and Services. In such instances, I am a data controller because I determine the purposes and means of the processing of Personal Information.
I act in the capacity of a data processor in situations when you submit Personal Information through the Website and Services. I do not own, control, or make decisions about the submitted Personal Information, and such Personal Information is processed only in accordance with your consents and instructions. In such instances, the User providing Personal Information acts as a data controller.
In order to make the Website and Services available to you, or to meet a legal obligation, I may need to collect and use certain Personal Information. If you do not provide the information that I request, I may not be able to provide you with the requested products or services. Any of the information I collect from you may be used for the following purposes:

Disclosure of information
Depending on the requested Services or as necessary to complete any transaction or provide any Service you have requested, I may share your information with my affiliates, contracted companies, and service providers (collectively, “Service Providers”) I rely upon to assist in the operation of the Website and Services available to you and whose privacy policies are consistent with mine or who agree to abide by my policies with respect to Personal Information. I will not share any personally identifiable information with third parties and will not share any information with unaffiliated third parties.
Service Providers are not authorized to use or disclose your information except as necessary to perform services on our behalf or comply with legal requirements. Service Providers are given the information they need only in order to perform their designated functions, and I do not authorize them to use or disclose any of the provided information for their own marketing or other purposes.
Retention of information
I will retain and use your Personal Information for the period necessary until the purchase order or Services are fulfilled, to enforce my agreements, resolve disputes, and unless a longer retention period is required or permitted by law.
I may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally. Once the retention period expires, Personal Information shall be deleted. Therefore, the right to access, the right to erasure, the right to rectification, and the right to data portability cannot be enforced after the expiration of the retention period.
Cookies
My Website and Services may use “cookies” to help personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.
We may use cookies to collect, store, and track information for security and personalization, and for statistical purposes. Please note that you have the ability to accept or decline cookies. Most web browsers automatically accept cookies by default, but you can modify your browser settings to decline cookies if you prefer.
Data analytics
The Website and Services may use third-party analytics tools that use cookies, web beacons, or other similar information-gathering technologies to collect standard internet activity and usage information. The information gathered is used to compile statistical reports on User activity such as how often Users visit the Website and Services, what pages they visit and for how long, etc. I use the information obtained from these analytics tools to monitor the performance and improve the Website and Services. I do not use third-party analytics tools to track or to collect any personally identifiable information of my Users and wewill not associate any information gathered from the statistical reports with any individual User.
Do Not Track signals
Some browsers incorporate a Do Not Track feature that signals to websites you visit that you do not want to have your online activity tracked. Tracking is not the same as using or collecting information in connection with a website. For these purposes, tracking refers to collecting personally identifiable information from consumers who use or visit a website or online service as they move across different websites over time. How browsers communicate the Do Not Track signal is not yet uniform. As a result, the Website and Services are not yet set up to interpret or respond to Do Not Track signals communicated by your browser. Even so, as described in more detail throughout this Policy, I limit the use and collection of your Personal Information. Social media features
The Website and Services may include social media features, such as the Facebook and Twitter buttons, Share This buttons, etc (collectively, “Social Media Features”). These Social Media Features may collect your IP address, what page you are visiting on our Website and Services, and may set a cookie to enable Social Media Features to function properly. Social Media Features are hosted either by their respective providers or directly on our Website and Services. Your interactions with these Social Media Features are governed by the privacy policy of their respective providers.
Email marketing
I offer electronic email updates to which you may voluntarily subscribe and unsubscribe at any time. I am committed to keeping your e-mail address confidential and will not disclose your email address to any third parties except as allowed in the information use and processing section or for the purposes of utilizing a third-party provider to send such emails. I will maintain the information sent via e-mail in accordance with applicable laws and regulations.
In compliance with the CAN-SPAM Act, all e-mails sent from Āio Art Therapy will clearly state who the e-mail is from and provide clear information on how to contact the sender. You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails or by contacting me.
Links to other resources
The Website and Services contain links to other resources that are not owned or controlled by Āio Art Therapy. Please be aware that I am not responsible for the privacy practices of such other resources or third parties. I encourage you to be aware when you leave the Website and Services and to read the privacy statements of each and every resource that may collect Personal Information.
Information security
I secure information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use, or disclosure. I maintain reasonable administrative, technical, and physical safeguards in an effort to protect against unauthorized access, use, modification, and disclosure of Personal Information in our control and custody. However, no data transmission over the Internet or wireless network can be guaranteed.
Therefore, while I strive to protect your Personal Information, you acknowledge that (i) there are security and privacy limitations of the Internet which are beyond my control; (ii) the security, integrity, and privacy of any and all information and data exchanged between you and the Website and Services cannot be guaranteed; and (iii) any such information and data may be viewed or tampered with in transit by a third party, despite best efforts.
Data breach
In the event Āio Art Therapy becomes aware that the security of the Website and Services has been compromised or Users’ Personal Information has been disclosed to unrelated third parties as a result of external activity, including, but not limited to, security attacks or fraud, I reserve the right to take reasonably appropriate measures, including, but not limited to, investigation and reporting, as well as notification to and cooperation with law enforcement authorities. In the event of a data breach, I will make reasonable efforts to notify affected individuals if I believe that there is a reasonable risk of harm to the User as a result of the breach or if notice is otherwise required by law. When I do, I will send you an email.
Changes and amendments
I reserve the right to modify this Policy or its terms related to the Website and Services at any time at my discretion. When I do, I will revise the updated date at the bottom of this page. I may also provide notice to you in other ways at my discretion, such as through the contact information you have provided.
An updated version of this Policy will be effective immediately upon the posting of the revised Policy unless otherwise specified. Your continued use of the Website and Services after the effective date of the revised Policy (or such other act specified at that time) will constitute your consent to those changes. However, I will not, without your consent, use your Personal Information in a manner materially different than what was stated at the time your Personal Information was collected.
Acceptance of this policy
By accessing and using the Website and Services and submitting your information, you acknowledge that you have read this Policy, agree to all its terms and conditions and agree to be bound by this Policy. If you do not agree to abide by the terms of this Policy, you are not authorized to access or use the Website and Services.
